Terms and Conditions
These Terms and Conditions ("Terms") govern your access to and use of the website, software, products, and services provided under the Deep Tweak Audio brand, operated by Major Hon ("Deep Tweak Audio", "we", "us", or "our").
By purchasing, downloading, installing, or using any Deep Tweak Audio product, you agree to these Terms.
1. Products
Deep Tweak Audio develops and sells digital audio software, including audio plugins and related software products.
Product features, system requirements, supported plugin formats, operating systems, and other technical requirements are described on the relevant product pages.
You are responsible for confirming that your computer, operating system, DAW, and other required software are compatible with the product before purchasing.
2. Orders and Payments
Payments for Deep Tweak Audio products are processed by Paddle, which acts as the Merchant of Record for transactions made through our website.
Paddle is responsible for processing payments, applicable sales taxes or VAT, payment-related customer service, and eligible refunds associated with transactions processed through its platform.
The final price, applicable taxes, currency, and payment methods will be displayed during checkout before you complete your purchase.
Your purchase may also be subject to Paddle's Buyer Terms and Refund Policy.
3. Software License
Unless otherwise stated, purchasing a Deep Tweak Audio software product grants you a limited, non-exclusive, non-transferable license to install and use the software for your own personal or professional audio production purposes.
Purchasing the software does not transfer ownership of the software or its intellectual property to you.
You may not:
- sell, sublicense, rent, lease, redistribute, or commercially distribute the software or license key;
- share your license key or account credentials with unauthorized users;
- modify, reverse engineer, decompile, or attempt to extract source code except where such restrictions are prohibited by applicable law;
- bypass, disable, or interfere with licensing, copy protection, or activation systems;
- distribute modified or unmodified copies of the software without written permission from Deep Tweak Audio.
You may use audio created or processed using Deep Tweak Audio products in commercial and non-commercial productions without paying additional royalties to Deep Tweak Audio.
4. Downloads and Activation
After successful payment, you will receive access to the purchased software and, where applicable, a license key or activation method.
You are responsible for providing a valid email address during checkout.
We may update our download, licensing, or activation systems from time to time. Reasonable changes to these systems do not affect your underlying license to use the product, subject to these Terms.
5. Updates
We may provide software updates, bug fixes, compatibility updates, or new versions at our discretion.
Minor updates may be provided without additional charge. Major upgrades or future products may require a separate purchase.
Unless explicitly stated otherwise, purchasing a product does not guarantee access to all future major versions.
6. Refunds
Refunds are governed by our Refund Policy, applicable consumer protection laws, and Paddle's applicable refund rules.
Where a refund is granted, your license to use the refunded product ends and any associated license or activation may be disabled.
7. Intellectual Property
All Deep Tweak Audio software, graphics, branding, documentation, website content, algorithms, user interfaces, and other materials are owned by Deep Tweak Audio or its applicable licensors and are protected by intellectual property laws.
"Deep Tweak Audio", associated product names, logos, and branding may not be used in a manner that suggests endorsement, partnership, or affiliation without permission.
8. Product Availability
We aim to keep our products functional and available, but we cannot guarantee uninterrupted availability of websites, download servers, activation servers, or online services.
Temporary interruptions may occur because of maintenance, infrastructure failures, security incidents, third-party service outages, or circumstances outside our reasonable control.
9. Disclaimer of Warranties
To the maximum extent permitted by applicable law, Deep Tweak Audio products and services are provided on an "as is" and "as available" basis.
We do not guarantee that every product will operate without errors on every hardware configuration, DAW, operating system, third-party plugin host, or future software version.
Nothing in these Terms excludes warranties or consumer rights that cannot legally be excluded.
10. Limitation of Liability
To the maximum extent permitted by applicable law, Deep Tweak Audio will not be liable for indirect, incidental, special, consequential, or similar damages arising from use of, or inability to use, our software.
This may include loss of projects, files, revenue, business opportunities, or data.
You are responsible for maintaining appropriate backups of important projects and files.
Nothing in these Terms limits liability where doing so would be prohibited by applicable law.
11. Termination
Your software license may be suspended or terminated if you materially violate these Terms, engage in software piracy or license abuse, fraudulently obtain the product, or interfere with our licensing systems.
Termination does not affect any rights that cannot legally be waived.
12. Changes to These Terms
We may revise these Terms when our products, services, business practices, or legal requirements change.
The updated version will be published on this page together with a revised "Last updated" date.
